  1. No Ive only been watching EPL mainly, I tried to watch some La Liga but goal tv sucks huge and screwed up both the Real Madrid and FC Barcelona match. I did see the Sevilla game for a second where the guy almost died in one of the freakiest things ive ever seen. Man U finally won, Nani, Tevez, and Ronaldo will be pretty formidable once they all start playing together (Ronaldo still suspended from a red card and Nani has only played sparingly outside of yesterday, Tevez missed the first game). Not to mention Rooney is down, so things arent so bad at Old Trafford.
  2. I live by the Sheridan Red Line (Irving Park/Sheridan) and lets just say it was decimated. Trees ripped apart (looked like a saw had cut through them at about 5 ft off the ground) and these were 20-30 ft tall trees. Light posts were on the street, it was pretty bad. A few blocks north where my apartment is though there was relatively little damage. But it looked abd.
  3. I dont even care what package they put it on, just go out and get it done RCN. I already am paying for the highest cable package possible, so I think its bogus that I cant just have my Big 10 channel. If I have to pay for an alternative lifestyle music channel, I deserve a Big 10 channel.

  7. I didnt forget it, As for negligent supervision, I dont really think that this is a case where you could say that some sort of supervision would have prevented it. I mean its not construction, or something where you are evaluating the work done, and bad work could result in injury. This is a person just stabbing some one for really no reason, unless the manager was physically standing between the customer and person, there is nothing they could do.

Haha yah not having the syllabus is a b****, but thats why they created "going to class randomly on the third week of school and asking a strange for a copy of the syllabus day", by that time no one will really think you havent been to class for 3 weeks and will believe your "I was out studying and must of lost it in the library". 1 class in college I went to 1 time, for papers I would show up at the end of class as it was being dismissed and sneak in as people were leaving and go to the front to turn in my paper cause they always collected them at the end of class. My roomate is going back to school this year (haha its classic too because hes going back to Wisconsin just like the Rodney Dangerfield movie, except hes only in his mid 20s), so Im jealous as hell of him because while I work my lame 9-5 job hes going to be living the sweet life again.
  11. Why? All classes are equally bad, most classes I attended like 3 times the whole semester. And if a class was before 3pm Id never show. College was the best.
  12. I dont think I ever attended class for the first week. College rules, in honor of this, I am going to turn my apartment into a pseudo dorm for the remainder of the semester.
  13. Yeah the pk kick was pretty brutal in a close match. It was an early season match and you could tell both teams were still feeling each other out. Didnt get to see ManU this weekend, but I hear they are struggling.
  14. I dont really see how you could sue Imus. Last I checked insulting some one is not a recoverable offense, not to mention truth is a defense to slander/defamation and what he said while offensive was basically true. Also there are other problems with the lawsuit, id argue that by being basketball players they were in the public eye and therefore Imus would have to have malice in his statements (knowledge of their falsity), etc etc. Not to mention the problem of damages, and it just is a waste. But when racial motives are involved generally cases are not so clear cut. IE If some one called a Walton a ginger or a redheaded whitey, I doubt that anyone would even care.
  15. Itd be hard to win on the DD case. Normally the law of respondeat superior states that the principal (employer) is liable for the torts of his agent (employee) while they are working for the benefit of the principal. An exception to this rule is when the tort is outside the ordinary/customary role of the employee, so as not to give the employer unlimited liability. In this case (as compared to a bouncer or some sort of job where physical contact may be required) an employee stabbing another person seems to be so far outside of the scope of his employment that it would be hard to find the DD shop liable. I mean there is a whole huge list of facts that I could go through to perhaps try and find a way to get around the general legal principle that it is outside the scope of employment, but they would have to be facts that were present. IE if the DD employee had a criminal record of violence, then perhaps argue in the alternative that DD negligently hired some one. But generally stabbing is not considered covered (most intentional torts are not good respondeat superior cases).

Otherwise what would be the point of the plea? http://www.boston.com/sports/articles/2007...ck_funded_ring/ And isnt it true Mr. Taylor that in return for your testimony against Mr Vick today that you would not be charged with any subsequent crimes? That you would not be charged personally for the murder of any of the dogs? That you will be facing a maximum penalty of 5 years versus in excess of 20? (Last one would be objected to but the point would remain) These guys are getting sweetheart deals, because I dont really see them as any more innocent or guilty than Vick, the difference is no one cares about Mr Taylor, but Mr Vick is a big fish. I generally dont care about witness flipping if it is in a case to get a larger more dangerous target, but I really dont think that the streets are any better if Vick is convicted versus the other 3, its not like he is the head of the Chicago Outfit. And OJ Simpson style verdict is much more common than you think, almost every judge has a bunch of stories where the defendants were guilty as sin but for one reason or another the jury was unwilling to convict.
  17. I dont see what the problem with the power a judge currently has. After a lawsuit is filed you can motion to dismiss for a variety of reasons. There is summary judgement, there are pleading deficiencies, etc, but the purpose of our court system is to put the rule of law in the hands of the people if that is what the defendant decides. Therefore while the judge has the power to use summary judgment and grant motions to dismiss, it is 1) only in cases where there really is no argument to be made, 2) it is often not reported because even Westlaw only reports appellate level cases and higher, so you generally do not see a lot of information on the cases that the judge ruled in favor of summary judgment (except for an appeal of the summary judgment but even in those cases it is then rare for that person to go and actually win). And court costs are pretty expensive, just to open a case at Daley Center is like $194 and that is for less than $10k, if you want more money or to go to a more expensive division (ie law which at Daley center just means civil for more money strange how they label things) the court costs alone start to rise. Then you are paying an attorney, etc. I guess I just think that while you could speed things up make them cheaper, you start to erode the entire system. The point is that some times juries, people, will disagree with a judge, and that is why it is imperative to allow even cases with a slim chance to be taken to trial. On the other hand, if it is a bench trial (no jury) then it some times does seem odd to play out the game when the judge already knows the results.

  19. None of the presumed top 4 played today, although Everton / Reading was an interesting match. Im a big fan of Arteta for Everton and think he really has a nice style of play although he lacks top flight speed. Reading's defense has looked good all year and Bikey (a bigger british guy) played a good match marking Johnson. Tomorrow Chelsea v Liverpool, which should be a good one. Im picking Liverpool in this one.
  20. The problem for Vick may be, accepting any sort of plea bargain may result in the end of his NFL career. So eventhough the risk will vastly incrase, a trial may be the best option because; a) the Falcons will have to pay him for the duration of the trial (potentially if he accepts a plea and goes to jail they could void teh contract) so if the trial drags a few years (think R Kelly) he may get the full value of his contract and at that point whatever happens happens, B) eventhough things may look grim trials are not exactly a sure thing for the govt in high profile cases, if anything the govt has generally not done so well in high profile cases (vicks money really evens the playing field usually prosecution has basically unlimited resources and that drainst eh average defendant, vick can fight for years with the best money can buy). Whenever a govt case rests on "flipper" witnesses, it is inherently weak. The witnesses who saw vick commit the crimes are not going to be the type of people that you would generally believe. Vicks defense team will attack them and the fact that they are testifying to save their own ass, so it will play off to the jury that the only reason vick is being implicated is because by fingering him the witnesses are themselves getting out of their own crime, which is a very powerful incentive to perhaps exaggerate Vick's involvement. because if there was no Mike Vick in this case, there is no way in hell the govt is cutting deals with the other defendants. I can definitely see vick being able to beat a guilty rap, especially because his lawyers should be amazing at picking jurors and all it will take is one to just not want to convict. And I think that vick is most likely guilty, but at the trial it might go differently.
  21. For all the money hes going to waste on these lawyers he could have just thrown it my way and Id tell him exactly why there is absolutely no chance he will win. He is a public figure, therefore defamation/slander require malice (the legal definition of malice, which is knowledge of its falseness). How exactly are they going to prove that Schilling knew Bonds wasn't cheating? As for why he didnt sue the Dr. its because that would be a blood bath. The Dr. will go on the stand and say Bonds absolutely knew, Bonds will say he didnt, and then its for a jury to decide? Not the type of odds you are risking when you already have all the money you ever need.
  22. Its hard to tell because there are a large variety of aircraft. When I was out at lunch about 1 pm it sounded like F-14's.
  23. Wisconsin has a much better track record against OSU over the last 10 years than Michigan. Not saying OSU is any slouch, just that for Wisconsin its generally 1 team that they can never beat, and that team is Michigan.
  24. I didnt get Resistance yet, and probably will wait a bit before I buy another game. Madden will be quite the work load so im going to try and hold off.
  25. Just got a PS3 with the 80 gig and Motorstorm so I could have Madden on HD. Its hard to judge on the first day because your just nto as used to the game paly so it always seems foreign. The graphics on MOtorstorm are pretty sweet though.
