Of course it is...take it as a minor suggestion. 

It is more than mildly annoying to me though. 

I think I speak for a lot of people that think that if it isn't going to ever work properly, just turn it off completely. 

The inconsistency of the broken filter drives me bonkers. 

Though I completely understand if it's so broken that it can't be turned off either. I was in UX QA for 5 years.

I really think as you are the first person losing their mind about this, that the scope here isn't "a lot".
