Consent has no legal significance, does not foreclose prosecution and places other women in danger.

You can legally bet on baseball, but baseball can ban you. You can legally appear in a porn movie, but baseball can ban you. There are legal supplements that you can take but baseball can ban you. You can scream all the racists crap you want, but baseball can ban you. 

This isn't about him doing something illegal. This is about decent people boycotting a product if they employ someone like him. If you own a company you don't have to continue to employ someone who you believe is bad for your business

I meant more along the lines of criminal legality.  I understand MLB can enforce a standard of conduct but if a person won't press charges they are consenting to the behavior.

On a practical note, you are correct. But to be accurate . . .

A person doesn't press charges. They can refuse to testify. They can not report the crime. But only prosecutors have the legal authority to actually press charges and bring someone to trial. 

Imagine two gang members shooting at each other. Neither one "presses charges" so they can't be prosecuted? That isn't in the public's interest. 

There is only one state that recognizes mutual combat. Someone can ask you to assault them, they can write a nice note, etc but it is still illegal in all but one state.

Again, most prosecutors would refuse to bring a case to trial if the victim refuses to cooperate. Especially if the victim hasn't also committed a crime. 

Which is a weird way to come back to the shooting. If the victim isn't cooperating why would police put any effort in?

Are you sure one one state where “mutual combatants” are routinely not prosecuted even with significant evidence.

I believe this is a widespread fashionable approach among many current American DA offices. It is certainly the approach in Cook County, whether it’s codified or not.

It's undefined which gives prosecutors wide discretion in Illinois. Depending on POV does it waste tax payer money to try to prosecute without victims willing to testify?

I believe criminals should be prosecuted with enough credible evidence, and the fact they are not has increased crime rates significantly. Juveniles can literally get away with murder here.

Looked it up, Texas is the state where it’s legal under the penal code, though I would think the two parties need to agree to the combat before hand, and not just claiming it after an ambush / shooting.

There's certainly more distancing from that area of sexuality in the typical big league clubhouse...and there are certainly numerous bullying and worse incidents to back that up, from Vizquel and the Blackhawks.

I don't think it's that complex, I think it's actually common sense. Do you achieve an erection by choking and beating your sexual partner within an inch of their life? Personally, I don't. I actually think it's pretty fuckin' weird. It seems like a mental disorder that a kinder society might've picked up on and intervened in earlier to prevent these sorts of heinous acts from happening. Yeah it is heinous, it is immoral. I'm not religious, my politics tend toward left, but I'm a human being and I know what's right and what's wrong regardless of the very American logic of 'it doesn't affect you, just mind your business' because it does affect me and the rest of society. It's liberalism turned hedonism. Why care about a baseball player? Because sport reflects society, especially baseball and American society. I want the White Sox to win but I also want these 'role models' to actually act like role models, they're paying them enough money and it isn't that hard to not be a scumbag. And these guys like Bauer make things worse for themselves by acting like entitled children, that everyone else has wronged them and it has nothing to do with their own actions. I'm not "woke" in the sense that I think women might lie about such things because the millionaire athlete didn't submit to extortion. But look at Derrick Rose. He "won" his case and couldn't be convicted of a crime, but all the evidence nonetheless exposed him as a slimy weirdo. Trevor Bauer may not be a criminal who deserves life in prison, but I don't want to root for that loser and I don't want my team to sign him either.

All I know is that it's a very slippery slope between a Clevinger and Bauer.

Would like to see the internal polling of women who attend Sox games (at least ten times per season) and how many attended fewer games than past seasons or watched fewer games on TV specifically due to that signing?

If you were one Bauer signing away from 88-92 wins versus 82-86, for example...it wouldn't be worth it obviously.

Bauer wasn't banned because of what he allegedly did at the time:

1. Bauer was banned because he's a prick and he's universally hated; when he was accused and being investigated, he attacked baseball. Meanwhile, someone like Marcel Ozuna and Urias have committed terrible acts but they've shut up, been good little soldiers, and were admitted back into the game.

2. Bauer faces 3 other accusers currently. Could it all be BS? I mean, I guess but this really is a reflection of what an asshat this guy is.

I've said this before but baseball, generally speaking, is a conservative game; players lean towards being conservative, leadership certainly is, and politically speaking Bauer is not an outsider. He's just such a d-bag that the only friends he ever makes around the game are guys like Clevinger.

Both Clevinger and Bauer might not be woman abusers (they also very well might be, as where there's smoke often times there are fires in that world), but they're shitty human beings even beyond your typical rich-prick standard.

Listen, I don't disagree with what you're saying. Its easy to sit here at your computer and say "Well I don't get why you need to choke someone to get off. Just don't do it". That's not how this works. I don't understand why people do drugs. Im not into that, but that's exactly it im not them and humans don't all share the same interests and desires.

I completely understand why people wouldn't want Trevor Bauer on their team and why they don't want to root for him. That doesn't mean he shouldn't be allowed to be on a team period because some private thing hes into was dragged into the spotlight for malicious intents.

Before anyone knew about this stuff or stalking college women on the interwebs, this asshat has been run out of every clubhouse he ever played for, which is why I was happy the Sox didn’t acquire him, and that the Dodgers did.
