Gregory Haidl was arrested at 5:20 p.m. Thursday after investigators stopped him at Pacific Coast Highway and Street of the Golden Lantern in Dana Point, said Orange County Sheriff's Department Watch Commander Hayward Miller. "The District Attorney did issue a warrant for Mr. Haidl's arrest on a charge of sex with an underage female," he said. Miller did not know whether investigators were on their way to Haidl's residence to arrest him when they found the teen in the car with his mother. "Once a warrant is issued for an individual's arrest then they are subject to arrest on sight," Miller said. Haidl was booked into the Orange County Men's Jail where he's being held in lieu of $100,000 bail. Haidl was recently tried for the alleged rape of an unconscious 16-year-old Rancho Cucamonga girl. Kyle Nachreiner and Keith Spann, both 19 and from Rancho Cucamonga, were co-defendants in the case, where each faced 23 felony sexual assault charges and one count for assault with a deadly weapon. The jury hung, and the judge declared a mistrial. Prosecutors said they plan to retry the case. The three were on trial for a two-year-old incident that occurred at the Newport Beach home of Don Haidl, Gregory Haidl's father, in which they are accused of videotaping themselves gang-raping an unconscious girl with a pool cue, Snapple bottle, juice can and lit cigarette. On Wednesday, deputies with the Orange County Sheriff's Department answered a call of a barking dog and a possible disturbance of the peace at 12:20 a.m. Deputies found Haidl, along with one male and three female minors at the residence, said Jim Amormino, public information officer for the Orange County Sheriff's Department during an earlier interview. None of the teens lives at that residence, Amormino said, adding that one was pet-sitting at the home. While there, deputies took a report on a possible incident of unlawful sexual intercourse, according to Amormino's statement. However, the alleged victim refused to sign the complaint, Amormino said. A small amount of marijuana was also found in the residence, but no one claimed possession. Amormino would not release the exact age of the girl involved, though his statement said the victim is "under 17 years old." Deputies took a misdemeanor report early Wednesday morning because there must be three or more years between the adult and child for the unlawful intercourse to be considered a felony. Statements made by some of the occupants of the house led deputies to believe there had been unlawful sexual activity, Amormino said.
