Is there any reason the government has to do this? It sounds like the excuse is more along the lines of, going w/ the "spirit" of the amendment, but I'm not sure. Rex Kickass Posted December 3, 2004 Author Share Posted December 3, 2004 Problem is, the state may not be legally allowed to honor that clause of its contract because of the passed amendment. What may very well happen is that this will go to the courts - as a test case to the constitutionality federally of the state amendment. Assuming that a lower court would issue an injunction preventing the clause being pulled from that contract, this may be a good thing for the state as a whole. It would be a good test to see if that amendment holds water against the federal constitution which supercedes language in state constitutions.
