YASNY
I have to admit ... I never gave a thought to the doctor/patient confidentiality issue. It never entered my mind. So ... why would Magglio ask the doctor not to update the Sox on his condition?
Steff
No need to be sarcastic, I'm just going by what Dr. Weil is quoted as saying in today's papers. Where's that quote.. I have yet to see either paper and am counting on you guys to be accurate.. TIA.
thomsonmi
This whole thing is old news. As far as I'm concerned, the Sox were lucky that Maggs wasn't smart enough to sign for the $70 million. Because there's no way he's getting that kind of money now. And, folks, last time I checked we hadn't won diddly with Maggs in the lineup. I liked him but he's replaceable. And, I suppose a real GM would just sit back and let Scott Boras kick his ass in the press. Screw that. Boras is an ass and Maggs has sold himself to the devil by turning to him. I'm frankly proud of KW for calling out Boras. Boras is the definition of what's wrong with sports. Sure I'd like to see JR blow his cash like Steinbrenner or Cuban but he doesn't that's what we are stuck with. And, laying blame for that on KW is not right at all. KW has made mistakes but in my judgment for the last two years he has busted his butt to bring a championship to the South Side. The Everett/Alomar thing two years ago didn't work but at the time all of us were ecstatic. Last year, he went out and got Freddie Garcia and traded Esteban just before he completely collapsed to get Contreras. You can't blame KW for the injuries to Maggs and Frank. The relentless attacks on KW are really getting old. It's been four years since the horrible Todd Ritchie trade. Get over it folks... As I have said time and time again on this site, KWs weakness is that he's too quick to pull the trigger which means often we give up way too much. But, the funny thing is he's criticized time and again on this site for not doing enough. My worry is frankly that he does too much. Rant over... Texsox
Let's take a ride in the way back machine and set the dial for last off season. When the Rangers - Red Sox - White Sox trade fell apart there were questions: A. Could Nomar play for the Red Sox after this? B. Could Maggs play for the White Sox after this? C. Could A-Rod play for the Rangers after this? We got the answers.
YASNY
Where's that quote.. I have yet to see either paper and am counting on you guys to be accurate.. TIA. Here's the appropriate text from the Rag ... I mean Trib. But Weil said Ordonez told him to keep it quiet, which he did. "He said, 'Don't tell the White Sox that I'm going,'" Weil said. Weil emphasized he was not acting in the capacity of a doctor with the Sox when he arranged for Ordonez to meet Schaden. He said he didn't feel an obligation to tell anyone on the Sox. "My first obligation is to the athlete," he said. After Ordonez had the surgery, Schaden called Weil and told him he found the meniscus tear and also performed "shock therapy" on the knee, a procedure that has yet to be approved here. Schaden said Ordonez should be fine and would not have any lasting effects of the injury. Weil didn't discuss his recommendation to Ordonez until reports surfaced that the Sox had advised the outfielder to go to Austria for the surgery, which drew heated denials from White Sox general manager Ken Williams. Weil then told trainer Herm Schneider about his conversation with Ordonez. "We did the best we could," Williams said. "We tried to get him the best medical attention. It's unfortunate it has to end this way. We wish him good luck."
CubKilla
Neither side is telling the 100% complete truth. Maggs is gone and Dye is going to need a career year in RF to put up Maggs-like numbers. I'm shocked that so many Sox fans are willing to take JR and Co. at their word. YASNY
I went back and reread the article ... in all fairness I have to post the paragraph immediately prior to the segment I posted above......... "They know everything went perfectly. They got all the medical reports. They said they never had them? That's [nonsense]. I was one of their employees then. They knew everything that was going on." EDIT: I have to question ... how did "they know everything" if he followed Magglio's instructions not to inform the Sox what was happening. This seems to be a contradiction. Partly truth and partly fiction.

CubKilla
And you apparently don't know the CBA very well.. That is a flat out lie because according to the CBA money can not be deferred for longer than 2 years unless approved.. and it must be with interest. Expect to see this get even more nasty. And the one to suffer will be Maggs. Hope he's pleased with his new rep. I think the "20 years..... deferred" was a misprint. I'm sure it was supposed to be 2 years, probably over the course the '05-'06 seasons. Then, in '07, the Sox would look to dump Magglio and a huge portion of the remainder of his non-deferred contract on some other team like they tried to dump him on the Red Sox during the '03-'04 offseason. Last night Bruce Levine made a good point about Dye replacing Maggs. It will be tough for Dye to put up Maggs' average career numbers, but he will hopefully and probably exceed Maggs' 2004 numbers. Guest JimH
But his relationship with the team would preclude him to advise Magglio without there being a connection to the team. I understand doctor/patient priviledge, what I don't understand is why Weil is now giving out all the details of the surgery if that is the reason he didn't tell the White Sox. I have a feeling he won't be the team podiatrist for much longer. DA, in answer to the first part ... that not true. The doctor has a private practice and anyone can come to him for analysis and advice. Including an employee of the team Dr. Weil has a contracted relationship with. Doctor/patient confidentiality is the huge issue here. Had Maggs given his written approval for Dr. Weil to share things with the White Sox, it would've been done. Maggs did not give his permission, in fact he specifically requested Dr. Weil not to do so. Advice from Boras, perhaps? On the 2nd part, why is Weil giving out the details now? One, Maggs has officially cut ties with the White Sox. Two, since that's the case, he's probably been asked by both sides to tell his story. Interestingly, the part that's missing from the Boras/Maggs camp is the issue of Dr. Weil not being an employee of the White Sox. They just say "White Sox team podiatrist" and gloss over the details. Steff
I'm shocked that so many Sox fans are willing to take JR and Co. at their word. Maybe because the doctor is saying the Sox didn't know - which is what they are claiming.

But I would bet against it also. He needs a few more Magg like years to even think about HoF. Those will come with another team. Think Kenny will trade for him in a mid season push? Steff
I wasn't talking about the doctor. I was referring to this entire situation as a whole. What about it..? The Sox offered Maggs a 5/70 contract - he confirmed that. The Sox didn't know about the surgery - the doctor confirmed that. Those are my only 2 issues. Harry Chappas
DA, I think the point being, this doctor is not an employee of the White Sox. He is the doctor the White Sox contract with if their players have foot/ankle problems. It's a bit misleading when he's called the "White Sox team podiatrist" because that intimates he's a White Sox employee. My understanding is, the only Sox employees who can be considered "medical staff" are the trainers, like Herm S., etc. It's very possible Ordonez went to this Dr. Weil on his own, i.e. to Weil's private practice. At that point, the doctor-patient relationship takes precedence over any relationship between Weil and the White Sox. There are federal patient rights confidentiality laws which address this issue. The White Sox can't force Dr. Weil to tell them about every consultation that was not referred directly by them. That is, very simply, against those laws. If this article is correct, Boras is telling a half truth here, and protecting his client. It's shady, but to be expected in the business of baseball. If Williams or Reinsdorf or any Sox executive tried to explain all this to the general public, it would only cause a bigger mess. I don't think people are willing to grasp the concept that an employee can confidentially go to a doctor who happens to have a relationship with the employer, and the employer knows nothing about it. Patients rights laws are very stringent on this whole topic. GREAT POST!!!!! Saved me a bunch of typing.
