I know theres the right to freedom of speech but do we really need a right that tells us to shut up? I think we need the order to remain silent. You dont have to obey a right, you only have to obey an order. And you only get that right when the police tell you to. What if no one else on this planet could be quiet simply because nobody gave em the right? Wed all be pretty fed up with life by this point... If you want to call your boss an asshole, but you need your job, you better exercise your right to remain silent. If you feel like saying something racist, but you're the only person in the room of your own race, you'd better exercise your right to remain silent. If you're a Cub fan in a room full of Sox fans....exercise your right to remain silent, right? If you're being arrested, you shouldn't need an order to shut up. You should be smart enough to know that talking is against your better judgment. The cops wouldn't mind if you kept yapping, because you'd surely say something to f*** yourself over. Or just looking at things from a different manner. Like with "I learn something new everyday". You dont learn anything new. You learn something old. Lets say someone tells you two plus two is four and you didnt know that (I pray you do ). You learned something new but its just old news to the fellow that told you. You get the order because lawyers and judges say the police have to explain to you what your rights are. Also, you cannot invoke your "rights" if only being questioned by the police without the police officers taking you into custody. Failure to answer a question when asked by police when you are not under arrest could lead to a charge of Obstructing a Police Officer. SI1020 Posted April 6, 2003 Share Posted April 6, 2003 Although the Miranda ruling came down in 1966 it was not a completely done deal until fairly recently. A little known section of the Omnibus Crime Control Act of 1968 passed by Congress stated that a confession or statement obtained voluntarily was admissable regardless of whether or not the defendant had waived Miranda rights. Almost all juridictions were following Miranda and countless confessions were thrown out because a defendant was not properly "Mirandized". However in February of 1999 the US Court of Appeals Fourth Circuit in a 2-1 decision upheld that section of the Omnibus Crime Control Act stating "voluntary" admissions were legal. Of course the case eventually went to the Supreme Court which ruled in late June of 2000 ( Dickerson V US) in a 7-2 decision reversing the Appeals court and affirming Miranda for all time. The Supreme Court verbally spanked Congress but good, stating in no uncertain terms that Congress had over stepped its bounds in attemting to overturn Miranda. The majority decision authored by Chief Justice William Rehnquist stated in part "In Miranda we note that the advent of modern police interrogation brought with it an increased concern about confessions obtained by coercion .... This court declines to overturn Miranda .... Miranda has become imbedded in routine police practice to the point where the warnings have become a part of our national culture." These boards can be extremely frustrating at times that's for sure. Maybe he should read a copy of James Wambaugh's The New Centurions. That little "thin blue line" is all that separates all of us from anarchy. Try studying the Montreal Police strike of 1969 or LA on or about 4-29-92. Better yet, get in a real tight spot and call 911 and get no response. I've never been a cop but have worked for a big municipal police dept as a civilian and have done a lot of investigative work for lawyers and insurance companies with moonlighting cops as partners. It's not the 40's and 50's, the job is tougher than ever and very few use the phone book or the night stick anymore. Like SI says there is a thin line and with Cops or any job where your life is on the line, it is amplified because they are thinking about saving their lives as well. In terms of cops, ya there are some of them that are just jerks, but most of them are normal people that you'd have a fun time hanging out with on the weekends and being proud to call them your friend. They do a pretty damn good job on the most part too and they don't get near the respect they deserve, mainly because a few rotten incidents are what always gets talked about.
