LINK MSNBC News Services Updated: 1:36 p.m. ET April 7, 2005SANTA MARIA, Calif. - A former Neverland ranch security guard testified Thursday that in the early 1990s he saw Michael Jackson perform oral sex on a boy who later received a financial settlement from the pop star. Ralph Chacon was called by prosecutors in Jackson’s child molestation trial in a continuing effort to show the singer had a pattern of molesting or inappropriately touching boys, which would support the current accuser’s claims. Chacon said he was making his rounds at Jackson’s estate on an overnight shift in late 1992 or early 1993 when he saw Jackson and the boy in a whirlpool bath. He said he later saw them take a shower together, then leave the shower and stand naked across from each other. Chacon said Jackson caressed the boy’s hair, kissed him on the mouth and elsewhere and engaged in oral sex. The former guard testified that at that point he left. Chacon said that several weeks or a month later he saw Jackson kiss the boy. He said that the kiss was “passionate” and that Jackson then put his hands near the boy’s crotch. On cross-examination, Chacon’s credibility came under scathing attack. Jackson defense attorney Thomas Mesereau Jr. quickly established that Chacon had sued Jackson, claiming he was improperly fired, and that Jackson had countersued, accusing Chacon of stealing from him. The witness acknowledged he was ordered to pay $25,000 for allegedly stealing Jackson’s property, which Chacon said was only a candy bar. He also acknowledged that he and others were ordered to pay more than $1 million in legal expenses to Jackson but that he had not paid anything because he had filed for bankruptcy. The boy Chacon referred to received a multimillion-dollar settlement from Jackson in 1994 and refused to cooperate in a police investigation. No charges were filed against Jackson in that case. Expected on the stand are other former employees of the 46-year-old entertainer’s Neverland Valley Ranch who witnessed what they considered his inappropriate behavior around certain young boys. Prosecutors say that over the past 15 years Jackson has formed suspicious “special friendships” with a series of adolescent boys. They are expected to call witnesses to testify about his relationship with five of them. Among the five are two who reached out-of-court settlements with Jackson, and actor Macaulay Culkin. Representatives for the former child star, who insists that Jackson never behaved inappropriately with him, say he will not take part in the trial. Thursday's testimony follows a rare day off in the case as Superior Court Judge Rodney Melville had other business and Jackson attended funeral services for Johnnie Cochran, the "Trial of the Century" defense lawyer who represented Jackson when he was accused of sex abuse by a boy in 1993. That case ended in a multimillion-dollar out-of-court settlement. Witness mocked? Jurors in the Michael Jackson molestation case were apparently overheard laughing at a remark that might have been mocking a witness, although no court action was expected. advertisement “It is an unsubstantiated rumor and there is no investigation,” court administrator Darrel Parker said Wednesday. Jurors are strictly barred from talking about cases before they begin deliberating. On Monday, a 24-year-old man tearfully testified that Jackson touched his groin area over his clothes on two occasions in the late 1980s and under his clothes in 1990, each time while tickling him. Robert Cole, of British news station Sky News, said that as he walked past an area where jurors were taking a break behind a covered fence, he heard one juror mimicking someone crying, and others laughing. As Cole’s account circulated through the media, it turned into a story where reporters supposedly overheard a juror say, “Oh boohoo, Michael Jackson tickled me.” But Cole told The Associated Press he did not hear jurors use Jackson’s name and was not sure they were talking about the case. Incidents recalled on stand The 24-year-old's mother, a former Neverland maid, testified Tuesday that Jackson regularly shared his bed with Culkin and another boy — whom she once discovered showering with the pop star. The mother and her son also reached a civil settlement with Jackson for more than $2 million in the mid-1990s. Jackson was never charged with a crime in that case. “I came in and at first I thought they were playing in the bathtub or Jacuzzi and I didn’t see them. ... I walked in and they were in the shower,” the former housekeeper said, adding that two pairs of underwear lay on the floor nearby. She said she could see two figures, Jackson and the boy, in the steamed-up shower and recognized the underwear from doing the singer’s laundry. Jackson is charged with committing lewd acts on a 13-year-old boy at Neverland in early 2003 and plying the youth with alcohol in order to molest him. He is also accused of conspiring with his associates to commit false imprisonment, child abduction and extortion. Jackson’s lawyers say that his accusers, past and present, have been motivated by the prospect of lucrative settlements with the performer. They have portrayed the now-15-year-old boy at the center of the current case as a liar who was goaded into inventing the abuse by his mother. Now that it's come out that Mac did sleep in his bed (after both him and his family saying he didn't years ago) IMO, this guy has some credibility. His attorney has something to work with on this guy considering the guy stole from him and got canned and then tried to say he was wrongfully fired, etc. Still really gross. I'd think I'd go nuts if I were a jury in this case just having to listen to the things Michael has done with those boys.
