Queen Prawn Posted August 24, 2005 Share Posted August 24, 2005 I don't think Chicago should be named in this lawsuit. The cause was too many people and a keg on a porch. One report I read was that there were 57 people and a keg on the porch (it could be incorrect in quantity, but either way there were too damned many people on that porch). Anyone with common sense knows a porch like that won't handle that load in a static situation much less a dynamic one. Anyhow, that is just my honest opinion. AbeFroman Posted August 24, 2005 Share Posted August 24, 2005 Just to through it out to any other sox-fan lawyers out there... doesn't the plaintiff need to show that a municipality acted willfully and wantonly here? The governmental tort immunity clause should prevent the plaintiff from making a negligence case. My guess is that it would be pretty tough to show that the city acted intentionally.
