Avery Charged With Murder

Steven Avery has been charged with the murder of Teresa Halbach.

 

He's also been charged with mutilating her corpse.

 

Avery made his initial appearance in a Manitowoc county courtroom this afternoon, as his family and that of 25 year old Halbach sat in attendance.

 

A criminal complaint filed today says a state justice department DNA expert has identified DNA from charred human remains found on Avery's property as that of Halbach's.

Tuesday afternoon, the prosecution and defense asked the judge for a fair bail.

 

“The state argues that the character and strength of evidence in this case is substantial as alleged in the complaint there has been a DNA match or series of matches implicating Avery in the commission of each of these offenses,” Calumet County District Attorney Ken Kratz told the judge.

 

Defense Attorney Erik Loy says his client has already proven he’s not a flight risk. “Despite the fact that Mr. Avery knew about the investigation and new he was a suspect, he didn't go anywhere.”

 

Bail was set at $500,000 cash. Avery's preliminary hearing is scheduled for December 6th.

 

Avery has repeatedly told reporters he believes he's being set up because of his pending $36 million lawsuit against Manitowoc county for his wrongful conviction of a sexual assault, which kept him in jail for 18 years.

 

He was released two years ago, after DNA evidence proved Avery was not guilty
