BENTONVILLE — A Bentonville woman was formally charged Wednesday with raping a 13-year-old boy and exposing the child to HIV.

 

Donna Sue Mars, 42, is charged with rape, a class Y felony, and exposing another person to human immunodeficiency virus, a class A felony.

 

The criminal information filed against Mars accuses her of engaging in sexual intercourse or deviate sexual activity with the boy while knowing she was HIV positive.

 

Her arrest came after Benton County Sheriff’s Office deputies Andrew Oliver and Eric Jones responded to a domestic disturbance call at 2 a.m. Dec. 18 near Avoca. Two men were standing over Mars, who was lying on the kitchen floor. One of the men was yelling, "She raped my 13-year-old son," according to an affidavit of probable cause in the case.

 

The boy told Jones he was sitting in the kitchen and Mars started rubbing his thigh. He asked her to stop, but she did not.

 

The boy claimed he asked her to stop again, but she began performing oral sex on him, then one of the men walked into the kitchen and pulled Mars away from the boy, the affidavit states.

 

Mars was placed under arrest and was taken to the Benton County Jail. Deputies later learned Mars was HIV positive. That was confirmed during follow-up interviews, according to court documents.

 

Mars was released from the Benton County Jail after posting a $25,000 bond. She was ordered not to have any contact with the alleged victim and his family.

 

Her arraignment is scheduled for 8:30 a.m. Jan. 23 in Circuit Judge David Clinger’s court.

 

If convicted of rape, Mars could receive a sentence of 10 to 40 years or life in prison, and she could receive six to 30 years in prison for the other charge.
