Jamar Smith charged with felony DUI and failure to report accident

I had the exact same reaction at first to be honest, maybe it was because it was such a big game. But afterwards, as I thought about it....yeah I got enraged.

It's the exact defense I was expecting from him (he didn't have a cell phone is accurate after all) but i'm going to be sick. Reading this makes me convinced yet again he'll be back on the Illini after taking a plea. And if he was so suicidial, why we he having the time of his life at senior night. This story his more holes than the Cubs pitching staff.

I'm not trying to rip on you, but have you ever had a concussion? I'm going to be the lawyer here and say, isn't it POSSIBLE that, because of the concussion, he made some ridiculous decisions? I've had a couple of them myself and let me tell you...the only thing I could think about was the pain, not throwing up, and where the hell I was.

 

I'm not backing off my stance that if he wants to play, he's going to have to earn back that scholarship...or just walk-on, but to turn your back on someone is cruel.

Yes, I have had a mild concussion actually (explains a lot of my posts, eh?) similar to what Jamar was diagnosed with (which is why he didn't spend the night in the hospital). Jamar's problem is he's trying to have it both ways here. Either he was out of it, which means he couldn't have the common sense and decision making to drive back to his apartment, or he was adequate enough to drive back to the apartment, and thus could have at least called 911 when he arrived. Either he was out of it or he wasn't, and based on the circumstances, he's trying to have his cake and eat it too. And I have no problem turning my back on somebody who did as much wrong as Jamar did that night.

Why are these arguments exclusive?

 

A good lawyer will make the following argument:

 

Jamar Smith was injured and concussed after the accident. Because of this injury he was no longer capable of making well thought out decisions. In fact, he may not have been able to even answer simple questions like "How many fingers are being held up" or "What year is it?" Due to Mr. Smith's state of mind from the injury he can no way be held guilty for the decisions that he made after the accident, because he was not thinking straight. This includes the decision to drive home a destroyed vehicle, not call 911, and every other stupid thing he did.

 

Not sure why driving home a decimated Lexus in a snow storm falls under the category of "common sense" or "good decision making." He could have easily crashed again and killed them both.

I hope that one day, when someone close to you does something stupid, that you don't feel the same way. It's very easy for you to say this when you don't know the parties involved.

I would hope I don't know somebody that is stupid enough to do the things Jamar did that evening. Nothing resembling this has come up for me in 21 years though, I guess it's a good sign I can judge who would be too stupid to hang around.

I meant moreso that if he was out of it, he wouldn't have had the ability to drive the Lexus home, not even close, hence the exclusive comment. I mean, having had a concussion, he was either in the state I was where there is no way possible he could have even drove that thing home (right decision or not, because he'd have been just about in the bag) or he was in adequate shape to drive the thing home, in which case he could have AT LEAST told SOMEBODY to call 911. It's obvious he wasn't in mental state #1 since he drove back, although I will say he and Brian could have just as easily died if he had just stayed out at the crash scene considering how deserted i'd guess it was and he had no cell, so at least it worked out ok, even if by pure lucky circumstances.

That's the thing about doing stupid things. Sometimes, they just happen. Driving drunk is a stupid and moronic thing to do. Why aren't you putting blame on the other people in the house that let him leave? Shoot, he may not even remember leaving the house to drive Carlwell home. Again, I'm not saying he's right, I'm just saying you are being very cavalier with your feelings toward someone.

 

I hope that if you are ever at a party where there are drunk people that you have the cojones to grab keys, slash tires, whatever it takes to stop someone from driving drunk. And also, someone could seem perfectly fine (and I'm not saying Jamar did) and still get into a car and have a major accident....

 

I'm also not saying he shouldn't be punished, I'm just saying that turning your back on someone for doing something stupid is a bit rough. Especially since it didn't affect you personally.
