santo=dorf
http://abclocal.go.com/wls/story?section=l...&id=5236039 An officer found the heroin in a hidden compartment of a Ford Explorer that he stopped driving 76 miles per hour in a 70 mile per hour zone Friday night. I wonder if this guy was foolish enough to give the cop the right to search his car, otherwise what right did the officer have to search his car so througholy to find a hidden compartment? Because he was nervous and had a conflicting story? I think this guy could get out of it if it is revealed the cop illegaly searched his car. He should've watched this video. DrunkBomber
Depending on the situation I dont see any instance that would give the Cop probable cause. Unless the compartment was foolproof, which obviously it wasnt, youd have to be an idiot to let them search it.
NorthSideSox72
Its a legal cascade, that's how these things work. Like this.... 76 in a 70 gives him cause for a traffic stop for speeding. Evasive behavior or other activity by the driver prompts a request for a search. The request for said search could be worded in a manner such that the driver is unaware that he even has a choice, and gives the cop perimission. That permission allows the complete search. Or, alternately... The evasive behavior or such creates a scenario where a reasonable person (cop) thinks the person may be a threat, and that permits the "wingspan" rule into effect. Cop can search everything within that person's "reach" for weapons. Depending on where the compartment is, that may be part of the search. All that said, I tend to agree that cops should have better things to do than pulling people over for 76 ina 70. Unless there was really some other reason he suspected more, and the speeding was just his "in".

From the ACLU video. Cop: "You don't mind if I search your car? You don't have anything to hide?" Uh, yes. I mean no. It was a hispanic man driving a Ford Explorer. I wonder which year. From wikipedia: Demographics As of the censusGR2 of 2000, there were 7,505 people, 2,697 households, and 2,030 families residing in the town. The population density was 710.2/km² (1,839.2/mi²). There were 2,809 housing units at an average density of 265.8/km² (688.4/mi²). The racial makeup of the town was 97.30% White, 0.03% African American, 0.39% Native American, 0.24% Asian, 0.01% Pacific Islander, 1.12% from other races, and 0.92% from two or more races. Hispanic or Latino of any race were 3.53% of the population. Makes you wonder. I have a friend who is a new cop and...........well I'll keep to myself about his thoughts on minorities and people driving beat up cars. StrangeSox
If you turn down a request for a search, they can still bring in a K9 unit to sniff the outside of the car. If the dog alerts to a substance, they then have probable cause to search.
