So they got more jail time than Ligue did?  What kind of BS is that? :huh:

the sentencing reports must have interesting.

 

Ligue pere did the clean up his act thing which seems real.

 

These dudes must have done the "I have no problem, what's it to you" thing

It is difficult to judge this when you have players breaking eye sockets of other players in a fight with no legal reprecussion. Couldn't say that was part of the game, it was practice and they are teammates. Place that on the scale and fans are getting too much time. If the leagues care about the safety of their players they should also get worked up over player on player violence.

So because they guy is "sorry" the fact that Ligue's crimes were much worse than these two guys doesn't matter???

ligue cleaned up alright... but sitting in the ud at a ball game sipping on a beer while on national tv while his kid sits in boot camp for the next year for doing the same crime... who got the better end of that deal i ask ya????? ligue should never be allowed in a ball park ever again... and yet he gets to enjoy day games now.......anyone who jumps on a field who is not being paid to be there in uniform by either team should not be allowed back in any ball park ever again..... they just make those of us who can sit and behave ourselves take a bad name.... ;)

The question is thus, is the crime worse because:

It was on tv?

It was at a ballpark?

Involved a professional?

 

In other words should he have gotten more than if he tackled and puched a guy at the bar. What if he did the same thing during a game he was playing in?

 

Should we have different laws depending on who the victim is? A custodian gets you a fine, a teacher 30 days, and a pro athlete 1 year?

not because he was "sorry"

 

the state's attorney's ofice does an exhaustive pre-sentence report on each person to be sentenced. If someone convincingly turns their life around, the sentence recommendation will be different. Remorse is also a factor - and the prosecutor's office determines if there is remorse and if it is real. Howver, that is a very small variable.

 

And much of sentencing is placed on a grid now that "truth in sentencing" is in effect. You have all these pre-determined factors with variables for this and that and the other and out comes the sentence. For all we know, Ligue had a less, maybe far less, criminal record than those who get sentenced to longer periods. Prior records has a lot of impact on the grid. Working on a case right now where the prior record report surprised everyone and may have errors in it so we are trying to determine what is what.

 

The public has no access to presentence reports. They are not of public record. The only ones that I ever see is for the clients we represent. And if a law office has the rioght software, it is an easy matter to plug in the factors and variables and priors if any and the drug/alcohol assessment with the standards set by the elgislature and see where it comes out. Judges very very seldom deviate from that, because they will get appealed and reviewed and they hate that.

in this post and your other post in this thread, you make some excellent points. Are you just that smart or are you that smart and work in some level in the criminal justice system?

Sentences for crimes are independent of each other, no? What I mean is, it's not like a contract hearing..."Well, my client hit 20 homers while Player X hit only 15, so my guy deserves more money". Just because one judge let Ligue off easy doesn't mean the other judge has to let those jamokes off easier, does it?

 

I also remember reading after the last incident that those guys were saying running on the field is something everyone needs to do once in their life and recommends it for everyone. Doesn't sounds very remorseful.

remorseful or not .. none of those morons should be allowed to be let off any jail time, and to go one further never allowed in a park again.... most of us in the real world have enough sense not to run onto the field......even after having a few beers........ ;)

Thank you for the compliment. I just watch Law and Order a lot :D

 

When trying to make sense of something that seems senseless, it's always easier to look at similar situations for guidance. Our legal system isn't perfect but based on our ideals it's as good as we can get it.

 

This past spring a friend of mine was driving a group of young men (14-18) to a festival in Mexico, a few hours from here. His Suburban turned into a small plane, then a Maytag dryer, and leaving a couple boys injured. First order of business in Mexico is the arrest the driver and put him in jail until the facts could be sorted out. The kids were left without adult supervision. By our standards, this seems wrong. In a system based on guilty until proven innocent it makes perfect sense.
